By accessing or using BrixNation.com (the "Site"), including any of its dashboards, tools, pages or data displays, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Site.
These Terms apply to all visitors, users and others who access or use the Site. BrixNation reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.
2. Description of Service
BrixNation provides free, publicly accessible financial data dashboards, ETF sentiment monitors, dividend tracking tools and related informational content. The Site displays data including but not limited to ETF prices, dividend yields, moving averages, RSI indicators, safety scores and related metrics.
The Site is provided free of charge and is intended for general informational and educational use. BrixNation does not charge for access to any content currently available on the Site and does not require account registration.
3. No Financial Advice
Nothing on this Site constitutes financial advice, investment advice, trading advice, or any other type of advice. All content is provided for educational and informational purposes only.
BrixNation is not a registered investment advisor, broker-dealer, financial planner, or any other type of licensed financial professional. The Site does not provide personalized investment recommendations and does not take into account your individual financial situation, goals, risk tolerance, or needs.
You should not make any investment decision based solely on information found on this Site. Before making any investment decision, you should conduct your own independent research and, where appropriate, consult with a qualified financial advisor, tax advisor, or other licensed professional.

4. Data Accuracy and Limitations
Data displayed on the Site is sourced primarily from Yahoo Finance and other publicly available third-party sources. BrixNation makes reasonable efforts to display accurate data but makes no warranty or guarantee as to the accuracy, completeness, timeliness, or reliability of any data displayed.
Data may be subject to the following limitations:
- Prices, yields and returns may be delayed by 15 minutes or more
- Dividend yield figures may be inaccurate for newer or complex option-income ETFs
- Manual yield overrides are applied for select tickers where Yahoo Finance data is known to be unreliable — these overrides represent BrixNation's best estimate and may still be incorrect
- Data updates occur once daily after market close and may not reflect intraday changes
- Historical data such as 3-year or 5-year averages may be unavailable for newer funds
- Third-party data sources may experience outages, errors, or discontinuation of service
You assume full responsibility for verifying any data before relying on it for any purpose. BrixNation shall not be liable for any loss or damage arising from reliance on inaccurate, incomplete, or outdated data.
5. Safety Score Disclaimer
The "Safety Score" displayed on BrixNation's dividend boards is a proprietary metric calculated using a mathematical formula applied to publicly available data. The score is based on up to five factors: fund size (assets under management), volatility (beta), expense ratio, dividend yield stability, and return history.
The Safety Score is not a professional analysis, rating, or recommendation. It has significant limitations including but not limited to:
- It is entirely formula-based and does not incorporate qualitative judgment, management quality, macroeconomic conditions, or other factors a professional analyst would consider
- It may be based on incomplete data for newer funds with limited operating history
- A high Safety Score does not mean a fund is safe for your particular situation or risk profile
- A low Safety Score does not mean a fund is a poor investment
- The formula and thresholds may be updated over time without notice
- Data inputs to the score (from Yahoo Finance) may themselves be inaccurate
The Safety Score is provided as one data point among many and should never be the sole basis for any investment decision. Always conduct your own thorough research.
6. Intellectual Property
The design, layout, code, text, graphics, and other original content of BrixNation.com are the intellectual property of BrixNation and are protected by applicable copyright and intellectual property laws. You may not reproduce, redistribute, republish, or commercially exploit any content from this Site without express written permission from BrixNation.
Data displayed on the Site (prices, yields, financial metrics) is sourced from third parties and is not owned by BrixNation. Use of such data is subject to the terms of the respective third-party data providers.
BrixNation grants you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial informational purposes only.
7. Third-Party Links and Services
The Site contains links to third-party websites and services including Reddit (r/DividendKings), Yahoo Finance, and others. These links are provided for convenience only. BrixNation does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party website.
BrixNation uses the following third-party services in the operation of the Site:
- Yahoo Finance — source of market data, prices, yields and financial metrics
- hitscounter.dev — anonymous visitor counting (no personal data collected)
- Reddit — linked community at r/DividendKings (subject to Reddit's own terms)
Your use of any third-party service is governed by that service's own terms and privacy policy. BrixNation is not responsible for any loss or damage arising from your use of third-party services.
8. Limitation of Liability
To the fullest extent permitted by applicable law, the following parties (collectively, the "Protected Parties") shall not be liable for any damages of any kind arising out of or in connection with your use of the Site or these Terms:
Protected Parties means and includes: BrixNation; DividendKings; BrixNation.com (the website and all its pages, tools, data, and content); and any and all owners, founders, operators, administrators, editors, writers, contributors, staff members, employees, volunteers, contractors, freelancers, collaborators, advisors, moderators, developers, designers, data analysts, community managers, social media managers, and any other individual or party who has in any way participated in, contributed to, worked on, supported, or been associated with BrixNation, DividendKings, or BrixNation.com — whether in a paid or unpaid capacity, formally or informally, directly or indirectly, past, present, or future — and regardless of whether any formal legal entity, corporation, LLC, partnership, or other business structure has been or ever is formed in connection with BrixNation or DividendKings.
No Protected Party shall be liable for any:
- Direct, indirect, incidental, special, consequential, exemplary, or punitive damages
- Loss of profits, revenue, data, goodwill, or other intangible losses
- Damages arising from any investment or financial decision made in reliance on information displayed on the Site
- Damages arising from errors, inaccuracies, or omissions in any data, content, scores, signals, or indicators on the Site
- Damages arising from unauthorized access to or alteration of your data or transmissions
- Damages arising from any interruption, suspension, or permanent cessation of the Site or any of its data feeds
- Damages arising from any bugs, viruses, or other harmful code transmitted through the Site
- Damages arising from your reliance on any third-party data, links, or services referenced on the Site
- Damages arising from the safety score, sentiment score, or any other calculated metric displayed on the Site
This limitation applies regardless of the legal theory under which any claim is brought — whether in contract, tort, negligence, strict liability, or any other theory — and even if any Protected Party has been advised of the possibility of such damages. This limitation applies to the maximum extent permitted by applicable law.
In no event shall the total aggregate liability of all Protected Parties combined, for all claims of any kind arising out of or related to these Terms or the Site, exceed one hundred US dollars ($100.00).
9. Indemnification
You agree to defend, indemnify, and hold harmless all Protected Parties (as defined in Section 8 above) from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way related to:
- Your access to or use of the Site or any of its content, data, or tools
- Your violation of any provision of these Terms
- Your violation of any applicable law, regulation, rule, or third-party right
- Any investment, financial, or trading decision you make based on information obtained from or displayed on the Site
- Your reliance on any data, score, signal, gauge, indicator, or other output generated by or displayed on the Site
- Any content, communication, or information you submit to or through the Site or any associated community
- Any dispute between you and any third party arising out of your use of the Site
- Any claim that your use of the Site caused harm to a third party
This indemnification obligation applies to all Protected Parties individually and collectively — including any person who has contributed to BrixNation, DividendKings, or BrixNation.com in any capacity, whether paid or unpaid, past or present — and survives any termination of these Terms and your cessation of use of the Site.
BrixNation reserves the right, at your expense, to assume exclusive control of the defense and settlement of any matter subject to indemnification by you. You agree not to settle any such matter without the prior written consent of BrixNation and to cooperate fully with any defense or investigation.
10. Disclaimer of Warranties
The Site and all content, data, tools, scores, and services provided through it are offered on an "as is" and "as available" basis, without warranties of any kind, either express or implied. All Protected Parties (as defined in Section 8) expressly disclaim all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement.
No Protected Party warrants that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any data, score, signal, or other information displayed is accurate, complete, current, or suitable for any particular purpose.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Georgia.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
